Marking him now, thanks for the report. Also, please feel free to dispute the payment with Paypal. The only time charge backs are okay are when the items are never received as this conforms with Paypal's buyer protection policy.

this guy also tried to scam me the other day. unsuccessfully. But I have a question. Can I request a chargeback on a previous scam that was successful? I had sent him the money under "gift for friends and family" and paid the fees, but never got the buds (have proof fortunately ). Is there a way to get my money back in this instance?

Charge it back. PayPal usually takes the buyer's side. Provide proof and you should get your money back.
