    I have recently been marked for scamming on the following report:
    "Trading and brokering for scammers after receiving their final warning."

    I will hereby present my case and inquiry on my marked status. I have written a contention-centered argument that should fairly gauge the accusations on my name as well as defend my status and standings.

    Contention 1: No Basis of Banishment
    There is no thread/post regarding my banishment. Due to many implications such as, but not limited to, misunderstandings, impostors, ambiguous events, one should not be banned on no basis. There has not been a Scammer Report created conflicted towards my name. There has not been a Scammer Report that allowed me to defend myself. Furthermore, there has been no indication I would be in the vicinity of being marked as a scammer. This is an unfair action, that gives the victim (me) no chance to defend my honor and standing.

    An example would be the United States Justice System. Does the United States legal system allow prosecutors to throw people accused of committing crimes into prison? I hereby point out the Sixth Amendment of the United States Constitution (I am using the United States Constitution due to Valve being a US Based Company and this website being based in the US as well): "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."

    The accused does not simply go to prison (or in this case, marked/banished) without a fair trial. There was no specific circumstance in where I was contacted about the issues of my potential banishment. Thereby from the evidence induced, this is an unfair punishment deemed by the sixth constitution. Therefore, I am here to appeal this and right the wrong.

    Contention 2: Explanations of Recent Events and Evidence
    I would like to present some evidence on the matter.

    All of the above images will be used in my case to defend myself due to recent events and exchanges of items.

    I will first explain my relationship with Amuse. I have been friends with Amuse since July. We are both high end traders that spend a majority of our free time trading. Ever since we had met, we have begun asking each other for advice on trades, as well as friendly banter. Our relationship increased from simply acquaintances to good friends. It is at the point where I would be glad to lend Amuse 10 buds if he needed 10 buds badly, because I know Amuse would pay me back Amuse. I trust Amuse.

    On October 27th, 2012, I was asked by Penguin (http://steamrep.com/profiles/76561198044255126) if I would like to sell my backpack without the unusuals and craft numbers and my collectibles. I would like to state that I collect AWPs and craft numbers such as #73 and others that interests me. Penguin was using the site http://backpack.tf to value my backpack. In order to gauge the value accurately, Penguin asked me if I could remove collectibles, unusuals, and craft numbers from my backpack. If needed, I will gather Penguin direct posts (from him, himself) and have him post here vouching for this.

    Amuse was not banned on October 27th, 2012. Figure D shows that he was not marked on October 28th. As the good friend we were, I traded him my items to hold (Figure A, B, C) on September 27, specifically at the times listed in those images from my inventory history. I would like to remind the jury and admins that Amuse was not marked at this time (Figure D).

    Subsequently, later on September 29th, Amuse was marked for scamming (Figure E). Due to this sudden change, it looks quite obvious that I have received a bunch of items from Amuse, who is in this case, a Scammer (I believe he is innocent, but I am not in the position to argue). This reflects poorly on me, since it clearly looks like Amuse is having me broker his items since he was banned. But let me point out one important detail. These were NOT his items. I do not know how valuable a marked person's testimony is, but if it will be accepted, I can have Amuse post on this appeal and vouch for this as well.

    Due to the sudden change in ownership, it is pretty clear why this would reflect badly on my reputation. But once again, I would like to point out to my first contention, the right to a fair trial. From the admins point of view, it looks like I was brokering for a scammer which is where I assumed the reason for my banishment originated from. However, I do hope this second contention clears the aire of confusion.

    Contention 3: "After receiving last warning"
    Am I wrong to believe the last warning would be a SteamRep caution tag? I have not received a warning recently, nor was I notified it was my "last" warning. Furthermore, this whole case is over a misunderstanding of a lending of my items to a person that was not marked, but marked soon-after.

    Does SteamRep clear a record of warnings given to me? Since I have not been notified, since the definition of warning is "to give notice to beforehand especially of danger or evil" (http://www.merriam-webster.com/dictionary/warn). I was not notified of being banished or in the reason specified, "final warning" before banishment which would be a step before banihsment.

    This contention thereby proves the fault of the accusing reason, where I was given a "final warning". By no means was I notified of having a "final warning" and by no means should I be banned as a reason due of it. It would be unjust and unfair to the accused (me).

    Contention 4: My Standings and Reputation
    I would like to point out I have been an active and reputable trader for over many months. Not only have I been a trader, simply looking to profit, but also a guide, tutor, and a betterment to the trading community. I strive on my motto "to better serve and make you happy". There have been no negative reputations ever in my trading career. There have been countless number of "helpful trader". I have helped many traders avoid being scammed, as well as stopping sharkings and potential sharkings from occurring. Before this incident, there have been no reports of Sharking, Scamming, Hacking on my name. I would also like to point out I always thoroughly scan traders I trade with now, to make sure they are not SteamRepped marked. I always helps low-tier traders when I require low-tier items, and I always end a trade with "Tyvm good sir" or "Thanks mate".

    I am a collector. I collect items to help out the game itself as well as a fun hobby. I currently collect AWPs, #73, and interesting crafts.

    I have countless numbers of reputable trades from TF2 Outpost. (I cannot provide a link since I am banned from there, due to this SteamRep banishment)

    I have over 10 pages of comments showing my trustworthiness and helpful nature in my Steam Profile. (I personally do not think this is a reputable area to show my standings, but it is there on my Steam Profile)

    I have over 100 traders in my friends that would vouch for me. All traders in the community, all that I have traded with and helped. This is not a document-able credential, but it is a credential nonetheless.

    My point of this contention is to show I am not a cancer on the community. I am not a vile bug that should be picked off and forgotten. I truly do my best for this community, as well as the League of Legends community (another game I so much very love!). Despite some small mishaps and misunderstandings, I wish SteamRep would not mark me on such a menial misunderstanding. And this leads to the 5th contention.

    Contention 5: Rehabilitation
    SteamRep is an amazing site. It helps the trading community point out scammers, sharkers, and more. It helps the overall community and gives awareness to all traders. Without SteamRep, chaos would most likely ensue on the community. I am glad we have Mattie who spent his personal time building SteamRep. I would like to personally give my regards to all the people that are making this wonderful community function. I rather hoped I would not have to do this in a ban appeal, but since this may possibly be the final time I can speak to the community as a reputable trader, I would have liked to say it now rather than never.

    Also, not trying to kiss ass here, but I have been a fan of Mattie since Eventscripts, where I started my programming career and hobby. Eventscripts is one reason why I collect AWPs, as a token towards everything Counter-strike related including Eventscripts.

    I understand the misunderstandings are more serious then I am making them sound. Trading with scammers is always frowned upon, even if it was a simple misunderstanding (in this case a holding conflict).

    I propose the following as part of my rehabilitation if the SteamRep admins would hear me out. This appeal will be my official "final warning". If the admins feel it required, a SteamRep Caution tag will be used to enforce the final warning.

    Since I am quite the active trader, I have received countless amounts of trade requests in the ~3 hours I have been banished. Each trader that has asked to buy from me, I have responded with "I am currently marked on SteamRep. I am currently filing an appeal. I will be glad to trade with you once I clear things up! Sorry for the inconvenience, and have a wonderful day!"

    I can confirm that on the day October 27th, 2012 approximately 7PM EST, I asked Yodamadashi to divide his BP into sections so that I could judge the value of his BP for purchase with greater accuracy.

    I would also like to vouch for him.. He has always been a honest and legitimate guy, I have done over $2000 in trades with him in the past 6 months, seeing absolutely nothing that would make him deserve such a tag.

    Some quick points:
    • SteamRep is a community, volunteer-run warning system to help people avoid scammers. It's not governmental in nature, so the right to a fair trial isn't exactly applicable. :) The tags are meant to warn traders of those we strongly suspect being involved with scammers. It's more like a spammer blacklist service than a prison system. The site volunteers do try to be fair, though.
    • Diego wrote SteamRep :) I just volunteered much later to help code new features and help out where I can. He's the boss.
    • There was a massive redirection of unusuals from Amuse's backpack to yours after he was marked. You round-about acknowledge that without admitting that you actually traded multiple unusuals with a marked scammer. Given that Amuse was marked for knowingly brokering for a known scammer, to suddenly see many items sent to you, is an accomplice-level indicator. You've been warned before by UTC Admins about trading with marked scammers and you're too senior to ignore how terrible it looks-- a trade of this magnitude makes it look like you are working closely with them on the very same day they were caught working with long-time scammers.
    • If your statements are true, you deserve a CAUTION tag only and I'll voluntarily reduce it. Please add me to your friends list and get prepared to upload screenshots quickly so I can confirm a few details rapidly. Since I marked you, I'm not allowed by my own principles to handle your official appeal, but if what you say proves to be verifiable then I can reduce your initial tag and you'll still have a chance at a single appeal for SR CAUTION with an appeals admin other than myself. (And I can relocate this thread to the caution-appeal forum.)
    • You desperately misjudged your friends-- if what you're saying is true, I'm stunned that you would loan such high value items to someone who has the terrible judgement to decide to operate so shadily with your items (?) still in his backpack. Either you misjudged him royally, or you are happy working with someone who isn't reputable.

    This appeal will be archived until you sort out your trade ban from Valve. Given the year since, I doubt the trade ban is expected to be lifted.
