Trading with Scammers: appeal process

I've read some of the appeal processes and it is stated that the victim must be repaid/taken care of before you can send an appeal for a ban you have. For those who have traded with scammers, who is the victim and how can they be justified? I know that doing a trade back is a possible way to appeal the ban, but its likely that the person you traded with declines a trade back and/or by the time you get the report their backpack is empty. How can you appeal with these circumstances?

its regarding scammed items. If it was trading, where there was no victim, that rule does not apply.
